There is a little rubber grommet on the pedal that meets with the switch, if that grommet is missing your lights will stay on all the time. I ended up finding some at a small place in town wasn't ace they didn't have it actually but i think i have what i need gonna fit everything on tomorrow thanks for the input !

check the switch at the pedal. Unplug it and see if the brake lights turn off. might just be some dirt in the switch or the wires could be shorting. Biggest problem with most under axle cbe setups...the axle housing will rest on the exhaust when you jack the car up and let the rear suspension droop.
